BarkBack Terms and Conditions

Welcome to BarkBack! These Terms & Conditions (“Terms”) govern your access to and use of the BarkBack mobile application, website, and related services (collectively, the “Service”), operated by BarkBack LLC (“BarkBack,” “we,” “our,” or “us”).
By accessing or using BarkBack, you agree to these Terms. If you do not agree, please do not use the Service.
1. Informational Use Disclaimer
BarkBack is an AI-powered dog behavior analysis tool designed to provide educational, informational, and entertainment-focused insights about dog behavior based on user-submitted media.
BarkBack:
Provides guidance and interpretations only
Does not guarantee accuracy or outcomes
Is not veterinary, medical, behavioral, or professional advice
BarkBack is an informational and educational tool only.
You understand and agree that BarkBack’s outputs are estimates and interpretations, not definitive conclusions.
BarkBack does not provide medical, veterinary, behavioral, or professional training advice, does not assess safety or risk, and does not guarantee accuracy or outcomes.
Dogs are inherently unpredictable. By using BarkBack, you acknowledge and agree that you assume all responsibility and risk for how you interpret and act on BarkBack’s insights.
2. Eligibility
You must be at least 13 years old to use BarkBack.
By using the Service, you represent and warrant that:
You meet the age requirement
You have the legal capacity to enter into these Terms
BarkBack does not knowingly allow use by children under 13.
3. Accounts
To use BarkBack, you must create an account.
You agree to:
Provide accurate information
Keep your login credentials secure
Be responsible for all activity under your account
You may terminate your account at any time through the app or by contacting us. BarkBack may suspend or terminate accounts as described below.
4. User Content
Your Responsibilities
You are solely responsible for the content you upload, including videos, audio recordings, photos, and any associated information (“User Content”).
By uploading content, you represent that:
You own the content or have the right to upload it
You have consent from anyone who appears in the content
The content does not violate any laws or third-party rights
Prohibited Content
You agree not to upload content that is:
Illegal, harmful, abusive, or deceptive
Infringing on intellectual property or privacy rights
Dangerous or intended to cause harm
Intended to reverse engineer, probe, or exploit BarkBack’s systems
5. Ownership and License
1. Your Content Ownership You retain full and exclusive ownership of all videos, audio recordings, and other content you upload to BarkBack ("User Content"). We do not claim any copyright ownership of your User Content.
2. License to BarkBack By uploading User Content, you grant BarkBack a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and analyze your User Content for the following purposes, and other legitimate purposes related to operating, improving, and developing the Service:
Operating and providing the Service to you.
Improving our machine learning models and artificial intelligence systems.
Debugging and preventing technical issues.
3. Ownership of AI and Derived Data You acknowledge and agree that BarkBack owns all rights, title, and interest in "Derived Data." Derived Data is defined as:
De-identified, aggregated or anonymized statistical data.
Machine learning models, weights, embeddings, and algorithms trained on your content.
Behavioral insights and patterns extracted from User Content that cannot be used to identify you or your pet personally.
4. Commercialization Rights BarkBack retains the exclusive right to sell, license, and commercialize the Derived Data and AI Models for any purpose, including research, marketing, and business development. You are not entitled to any compensation from the commercialization of this de-identified, anonymized or Derived Data.
5. Restrictions on Selling User Content BarkBack will NOT sell, rent, or license your raw, identifiable video files to third parties for their independent marketing or commercial purposes without your explicit written consent.
6. Termination of License This license to your User Content ends when you delete your content or your account. However, BarkBack may retain Derived Data (as defined above) in perpetuity, as this data is no longer linked to your identity and cannot be reverse-engineered to reconstruct your original User Content.
6. Sharing, Social, and Public Use
BarkBack is designed to be fun, insightful, and shareable.
You may:
Share BarkBack results or analyses
Post screenshots or excerpts
Share content on social media or messaging platforms
You are solely responsible for:
What you choose to share publicly
Ensuring your shared content complies with the rules, terms, and community guidelines of any third-party platform
BarkBack is not responsible for:
How third-party platforms store, use, modify, or distribute shared content
Reposts, scraping, remixing, or redistribution by others once content is shared publicly
Any consequences resulting from public sharing of BarkBack results
Once content is shared outside the BarkBack Service, it is subject to the policies and practices of the platform where it is posted.
BarkBack is not responsible for how third parties interpret or use shared content or results.
7. AI Limitations and Disclaimers
You acknowledge and agree that:
BarkBack outputs are not guarantees
AI analysis has inherent limitations
BarkBack cannot predict dog behavior with certainty
BarkBack is not a substitute for professional training, veterinary care, or medical advice
You assume full responsibility for any actions you take based on BarkBack’s outputs.
8. Intellectual Property
BarkBack IP
BarkBack owns all rights, title, and interest in:
The Service
The software, AI models, algorithms, and outputs
Branding, design, and trademarks
You may not:
Copy, resell, sublicense, or commercially exploit BarkBack outputs
Use BarkBack outputs to train competing models
Reverse engineer or extract BarkBack’s technology
User Content Ownership
You retain ownership of your original content, subject to the license granted to BarkBack as described in these Terms.
9. Subscriptions and Payments
BarkBack may offer:
Monthly subscriptions
Yearly subscriptions
Free trials
Subscriptions automatically renew unless canceled in accordance with the applicable app store’s policies.
Payments are handled exclusively by Apple App Store or Google Play. BarkBack does not process or store payment information.
Refunds are governed by Apple’s or Google’s refund policies.
Pricing and subscription offerings may change in the future.
10. Account Suspension and Termination
BarkBack may suspend or terminate your account if you:
Violate these Terms
Misuse the Service
Upload prohibited content
You may terminate your account at any time.
Handling of your data upon termination is governed by the Privacy Policy.
11. Limitation of Liability
To the fullest extent permitted by law:
BarkBack is not liable for indirect, incidental, consequential, or special damages
BarkBack is not responsible for injuries, losses, or damages resulting from dog behavior
BarkBack is not liable for actions taken based on AI outputs
BarkBack’s total liability for any claim shall not exceed the amount you paid to BarkBack in the preceding 12 months, or $100 USD if no payment was made.
12. Indemnification
You agree to indemnify and hold harmless BarkBack from any claims, damages, or losses arising from:
Your use of the Service
Your uploaded content
Your violation of these Terms
13. Governing Law and Disputes
These Terms are governed by the laws of North Carolina, USA, without regard to conflict-of-law principles.
Before filing any legal claim, you agree to attempt informal resolution by contacting BarkBack.
Any disputes not resolved informally shall be brought exclusively in the state or federal courts located in North Carolina.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify users through the Service or other appropriate means.
Continued use of BarkBack after changes take effect constitutes acceptance of the updated Terms.
